Please read these Terms carefully before using the MONTAGNO GP website or our membership, circuit, coaching and clubhouse services. They set out the rules for using the Site, the basis of membership, and important information about safety, motorsport risk and liability.
01 Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of the MONTAGNO GP website (the "Site") and, where you are an applicant for or holder of a MONTAGNO GP membership, your relationship with the club and its facilities, events and services (together, the "Services"). By accessing the Site, submitting an enquiry or membership application, or using any of the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or the Services.
In these Terms, "we", "us" and "our" refer to MONTAGNO GP; "you" and "your" refer to the individual or entity using the Site or Services. We may update these Terms from time to time as described in "Changes to these terms" below.
02 About this Site and forward-looking statements
MONTAGNO GP is developing a global network of private motorsport circuits, garages, coaching programmes and clubhouses. Several destinations described on the Site — including our flagship at Batam Island and planned circuits in Jakarta and India — are currently in development or early planning.
Information about destinations, opening dates, circuit specifications, membership tiers, perks and pricing is provided for general information and marketing purposes. It is indicative, may be provisional, and is subject to change without notice. Nothing on the Site is a binding offer, guarantee, or commitment, and the availability of any facility, tier or benefit may differ from what is shown.
03 Membership eligibility and applications
Membership is private, discretionary and by application. Submitting an enquiry or application does not create a membership or any obligation on us to admit you. We may accept or decline any application at our sole discretion, and we may require references, identity verification, proof of age, a valid driving licence and other information before considering an application.
Members must be at least 18 years of age. You agree that all information you provide in connection with an application or membership is accurate and complete, and you will keep it up to date. Membership is personal to you, is non-transferable, and may not be assigned, shared or resold except as expressly permitted by us in writing.
04 Membership tiers, dues and fees
Where you are admitted as a member, your rights, benefits and access depend on your membership tier and are subject to these Terms, your membership agreement and any club rules in force from time to time. Membership may be subject to a joining fee, recurring dues and additional charges for specific facilities, events or services.
Fees and dues are payable in advance and, except where required by law or expressly stated otherwise, are non-refundable. We may revise tiers, benefits, fees and dues on reasonable notice. Non-payment may result in suspension or termination of membership and loss of associated benefits.
05 Bookings, track sessions and cancellations
Track days, coaching sessions, events and other bookable Services are subject to availability, capacity limits, scheduling and any eligibility or experience requirements we set. We may require completion of a briefing, induction or assessment before you participate.
We may reschedule, modify or cancel any session or event — including for reasons of weather, track or facility conditions, safety, force majeure, or insufficient participation — without liability beyond, at our discretion, a credit or rebooking. Cancellation and refund terms for paid bookings will be made available at the time of booking and form part of these Terms.
06 Safety, motorsport risk and assumption of risk
MOTORSPORT IS DANGEROUS. Driving on a circuit, riding as a passenger, and being present in pit, paddock, garage and trackside areas involve inherent and significant risks — including the risk of collision, mechanical failure, fire, serious bodily injury, permanent disability and death, as well as damage to vehicles and property. These risks cannot be eliminated.
You participate in motorsport and track-related activities voluntarily and at your own risk. As a condition of participation, you (and your guests) will be required to read, complete and sign a separate release of liability, waiver and assumption-of-risk agreement on-site, and to comply at all times with our safety rules, marshals’ and instructors’ instructions, flag signals, speed limits, and helmet, equipment and apparel requirements.
You are responsible for ensuring that any vehicle you bring is roadworthy and in safe mechanical and track-worthy condition, that you hold appropriate licences and insurance, and that you are physically and medically fit to participate. We may refuse or stop participation by any person or vehicle that we consider unsafe or non-compliant.
07 Vehicle storage and garaging
Where we provide vehicle storage, garaging or concierge services, these are offered subject to our storage terms and any fees. Unless we agree otherwise in writing, vehicles and their contents are stored at your risk, and you are responsible for maintaining your own comprehensive insurance.
You warrant that you are the owner of, or are authorised to store, any vehicle you place with us, and that it is lawful, registered where required, and free of undisclosed defects or hazards.
08 Member conduct and guests
You agree to conduct yourself in a manner consistent with the standards of the club, to treat members, guests, staff and contractors with respect, and to comply with all club rules, signage, and the directions of our staff. We may refuse entry, suspend access, or remove any person who behaves unsafely, unlawfully, or in a manner we consider detrimental to other members or to the club.
You are responsible for the conduct of your guests at all times while they are on our premises or using the Services, for ensuring they meet any age and eligibility requirements, and for ensuring they sign any required waivers. You will be liable for any loss or damage caused by your guests as if caused by you.
09 Acceptable use of the Site
You may use the Site only for lawful purposes. You agree not to use the Site in any way that breaches applicable law; that is fraudulent or harmful; that attempts to gain unauthorised access to the Site, member areas, servers or data; that introduces malware; or that interferes with the operation, security or availability of the Site.
Access to member-only areas (such as the member login) is restricted to authorised members. You are responsible for keeping your login credentials confidential and for all activity under your account, and you agree to notify us promptly of any unauthorised use.
10 Intellectual property
The Site and its content — including the MONTAGNO GP name, logos, brand marks, text, graphics, photography, video, layout and design — are owned by or licensed to us and are protected by intellectual property laws. You may view and use the Site for your personal, non-commercial use only.
You may not copy, reproduce, distribute, modify, frame, republish, or create derivative works from any part of the Site, or use our trademarks, without our prior written consent. All rights not expressly granted are reserved.
11 Submissions and communications
If you send us enquiries, applications, feedback or other information through the Site, you confirm that it is accurate and that you are entitled to provide it. You grant us a non-exclusive, royalty-free licence to use any non-personal feedback or suggestions you provide to operate and improve the Services.
We may record or photograph activities at our facilities and events for safety, security and promotional purposes. Use of personal data is governed by our Privacy Policy.
12 Third-party links
The Site may contain links to third-party websites or services that are not operated by us. We provide these links for convenience only and are not responsible for the content, products, policies or practices of any third-party site. Accessing third-party sites is at your own risk and subject to their terms.
13 Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on it is complete or current.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, or for fraud.
14 Limitation of liability
To the fullest extent permitted by law, and subject to the "Disclaimers" section above, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or opportunity, arising out of or in connection with your use of the Site or the Services, whether based in contract, tort, negligence or otherwise.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site or your use of it will not exceed the amount you paid to us, if any, for access to the relevant Service in the twelve (12) months preceding the event giving rise to the claim.
15 Indemnification
You agree to indemnify, defend and hold harmless MONTAGNO GP, its officers, directors, employees, agents and contractors from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms, your misuse of the Site or Services, or the conduct of you or your guests at our facilities or events.
16 Privacy
Our collection and use of personal information in connection with the Site and Services is described in our Privacy Policy. By using the Site, you acknowledge that you have read it.
17 Suspension and termination
We may suspend or terminate your access to the Site or the Services, and (in accordance with your membership agreement and our club rules) your membership, where you breach these Terms, fail to pay sums due, or act in a way that we reasonably consider unsafe, unlawful or harmful to the club, its members or staff. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability and indemnification — will continue to apply.
18 Changes to these terms
We may update these Terms from time to time to reflect changes to the Site, the Services, or for legal or regulatory reasons. The current version will always be posted on this page with its effective date. Your continued use of the Site or Services after changes take effect constitutes acceptance of the revised Terms.
19 Governing law and disputes
These Terms, and any dispute arising out of or in connection with them, are governed by the laws applicable at our principal place of business in IL, United States, without regard to conflict-of-law rules. Activities at a particular destination may additionally be subject to the local laws of the jurisdiction in which that destination operates.
You agree to first attempt to resolve any dispute with us informally by contacting us. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the competent courts of the jurisdiction stated above, except where mandatory local law provides otherwise.
20 General
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision is not a waiver of it. These Terms, together with any membership agreement, club rules, signed waivers and our Privacy Policy, constitute the entire agreement between you and us regarding the Site and Services. We may assign or transfer our rights and obligations under these Terms; you may not without our prior written consent.
